Introduction

Hello Her (Vyoraa Tech) treats data security and privacy with critical importance. Users and Listeners control what they share; we maintain measures to prevent leakage and unauthorized disclosure.

Data Management

We store only the minimum necessary information (e.g., name, age, mobile number). Data is stored securely, used for personalization only with permission, and kept private unless legally required to disclose.

Sharing with Third Parties

We do not sell or rent personal data. Information is shared only to provide services, under confidentiality agreements, or when required by law.

  • Harm Prevention: If it is reasonably believed that a User may cause harm to themselves or others based on shared information, the Company is at liberty to use all available information to take any action deemed fit.
  • Intermediary Status: As far as online involvement is concerned, Hello Her is an intermediary as defined under the Information Technology Act 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021. User generated content is not modified, edited, or manipulated.

Information Collected Indirectly

  • Service Support: Information may be received or collected to operate, provide, improve, understand, support, and market services.
  • Quality Enhancement: The types of information collected depend on how services are used and help in improving service quality.
  • AI and Moderation Training: The right is reserved to utilize data from User access and use including but not limited to text chats and voice call metadata for the purpose of training, enhancing, and maintaining AI models and moderation systems.
  • Confidential Processing: All such data is processed under strict confidentiality and privacy protocols to ensure platform integrity and safety.
  • Mutual Integrity: Parties are bound to secure each other’s information in accordance with law and maintain privacy ethics, being individually liable for violations.

Sensitive Personal Information

  • Medical Disclaimer: Users and Listeners are urged not to share sensitive personal information or core medical issues as Hello Her is not a medical facilitator and is not certified to practice medicine or advise on medication.
  • User Volition: If such information is shared, it is done so at the User's own volition.
  • Responsibility Waiver: No responsibility is taken by Hello Her for any sensitive information which the User may have chosen to share on the App.
  • Consensual Exchange: No responsibility is taken by Hello Her for the consensual exchange of information between Users and Listeners or any consequences following such exchange.

Payments

  • Transaction Information: When the application is used to purchase offers, additional information is processed, including payment accounts, transaction information, and payment methods.
  • Bank Verification: The name of the bank is received to confirm the bank account for use during payments.
  • No Retention of Sensitive Payment Data: Sensitive payment data, including debit card numbers, expiry dates, PINs, OTPs, or UPI PINs, is not retained by Hello Her as per statutory guidelines.
  • Encryption: Access to encrypted PIN software provided by payment corporations is not available to the Company/Hello Her.
  • Management of Data: Payment information may be managed, changed, limited, or deleted through payment settings or by deleting the account.

Excluded Services

  • No Emergency Access: Services do not provide access to emergency service providers, including medical, police, fire departments, or hospitals.
  • Direct Contact Advised: Users are advised to contact relevant emergency services in their local administration directly.
  • Non-Certified Guidance: Services are limited to providing general non-certified advisory, discussions, and guidance only.

Disclaimer & Indemnification

  • As-Is Basis: Services are used at the User's own risk and are provided on an "as is" basis without express or implied warranties.
  • No Warranty of Accuracy: It is not warranted that information provided is accurate, complete, or useful, or that services will be operational and error free.
  • Third Party Release: Users release and indemnify the Company/Hello Her and its affiliates from any claims or damages relating to disputes with third parties.
  • Indemnification: If a claim is brought against the Company/Hello Her relating to a breach of obligations by a User or Listener, the breaching party shall indemnify and hold Hello Her harmless from all liabilities, damages, and legal fees.

Dispute Resolution & Governing Law

  • Governing Law: The governing law shall exclusively be applicable Indian Law.
  • Jurisdiction: Any dispute arising out of or related to Vyoraa Tech shall be under the express jurisdiction of the courts at Bhopal, India.
  • Arbitration: All disputes shall first be referred to Arbitration under a sole arbitrator, appointed mutually or through an established chamber of commerce.
  • Arbitration Fees: The arbitrator’s fee shall follow the model fee under the Arbitration and Conciliation Act 1996, and the language used shall be English.
  • Jurisdictional Bar: Use of any services binds the User legally and expressly bars the jurisdiction of any other court or forum.
